Terms & Conditions for 2025 Koi Sweepstakes

Open to legal residents of the United States (excluding all US Territories including but not limited to Puerto Rico, Guam, and U.S. Virgin Islands).  

Entrants must be 18 years or older at the time of entry.  

Employees of Atlantic-Oase, their immediate families, and any affiliates or agencies associated with this sweepstakes are not eligible to participate.  

No purchase necessary. Void where prohibited by law.  

Participants who provide false information, violate the rules of the promotion, use automated means to enter, or attempt to manipulate the outcome may be excluded from participation. Atlantic-Oase reserves the right to disqualify entries that are offensive, unlawful, or infringe the rights of third parties.    

To enter, participants must answer the question as a ‘comment’,stating their favorite variety of koi and why, and confirm they residein the EU or US within their entry. This must be commented on the pinned sweepstakes post in the Oase ‘Show Us Your Koi Pond (Global Community Page by Oase) here.   

Only one entry per person is allowed.  

The sweepstakes begins on Monday June 2, 2025 at 11am GMT / 7am ET and closes on Monday June 30, 2025, at 11:59pm GMT / 7:59PM ET.  

One US winner will win up to the value of $7500 USD Approximate Retail Value (hereinafter ”ARV”) worth of Atlantic-Oase products.  

The prize is non-transferable, non-exchangeable, and no cash alternative is available.

The ARV of the prize is $7500.  

If the products chosen by the declared winner are above the value of 7500 USD ARV, then the winner must pay the difference. Payment must be made in full ahead of order confirmation and delivery timelines being confirmed.  

The winner will be chosen at random from all valid entries via “The good luck fairy”, a tool that randomly selects a winner from eligible entries. The decision is final. Legal recourse is excluded. There is no enforceable claim to the prize.  

The winner will be responded to by the official Oase ‘Show Us Your Koi Pond (Global Community Page by Oase) Facebook page on their entry comment on the pinned sweepstakes post.  

 The winner must respond within 48 hours to claim their prize. Failure to do so may result in a new winner being selected.  

The winner must provide Atlantic-Oase with an email address in order to redeem the full prize, and US delivery (residential) address (no PO Boxes).  

The US winner will be contacted by this email address [email protected] to facilitate ordering the chosen products and to arrange delivery.  

The winner is responsible forall applicable federal, state, and local taxes related to the prize.  

By participating in this sweepstakes (the "Sweepstakes"), you agree to the following terms regarding taxes and legal responsibilities:  

Tax Obligations:Any and all federal, state, local, and other taxes or duties arising from the receipt or use of any prize awarded in this Sweepstakes are the sole responsibility of the winner. The organizer of the Sweepstakes does not assume any responsibility for tax liabilities.  

Legal Compliance: It is the responsibility of each participant to ensure that their participation in the Sweepstakes does not violate any local laws, regulations, or restrictions. Atlantic-Oase will not be liable for any consequences resulting from a participant’s failure to comply with applicable legal requirements.  

Prize Reporting: If required by law, winners may be required to provide relevant tax or identification information for reporting purposes. Atlantic-Oase reserves the right to withhold or require additional documentation before awarding any prize.  

Liability Release: By participating, you release Atlantic-Oase, Facebook, and any associated parties from any claims, liabilities, damages, or losses arising from your participation, receipt, or use of any prize, including but not limited to tax implications.  

By entering the Sweepstakes, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.  

As the prize value exceeds $600, the winner may be required to complete a W-9 form and will receive a 1099-MISC tax form for reporting purposes. Atlantic-Oase does not give any tax or legal advice, this is the sole responsibility of the winner to ensure compliance with the applicable requirements.  

By entering, participants agree that Atlantic-Oase may use their details for the purpose of administering this sweepstakes.  The personal data which will be collected is name, Facebook profile, as well as contact information for the selected winner and shall be used for identifying the winner and contacting them. The collected personal data will be deleted after the sweepstakesends, unless legal obligations apply. Atlantic-Oase does not share the participants’ data with third parties. Atlantic-Oase may process data outside the US (in Germany) with the purpose mentioned above. Personal data will be handled according to our Privacy Policy here.  

This sweepstakes is governed by the laws of Germany. All disputes shall be governed by German law, and the courts of Hörstel shall have jurisdiction.   

Atlantic-Oase reserves the right to modify, suspend, or cancel the sweepstakes at any time.  

Atlantic-Oase is not liable for technical problems, delays, or third-party issues  

Any fraudulent or automated entries will be disqualified.  

The decision of Atlantic-Oase is final and binding in all matters related to this sweepstakes.  

This sweepstakes is not sponsored, endorsed, or administered by Facebook.  

By participating, entrants release Facebook from any liability related to the sweepstakes. 

Atlantic-Oase will cover the cost of standard delivery for any prize awarded.
